Modeci, Inc. ("Modeci"), the operator of this website, is committed to protecting the privacy of information provided to us by visitors to this website. This privacy policy describes our collection, use, sharing and safeguarding of information which you provide (directly or indirectly) while visiting our website.

Unless the context otherwise requires, the word "you" or "your" in the text below refers to a parent, legal guardian or other adult visitor to our website. Please refer to the Children's Privacy Policy below for special considerations applicable to children.

Collection of Information

Modeci may collect, in aggregate form, certain data regarding usage of this website, such as the number of visitors, the pages visited, etc., which does not identify any particular visitor. We may also use "cookies" to identify a browser session and provide faster access to pages on this website. However, these cookies are not used to store or collect any personal information about any specific visitor.

In general, Modeci does not collect personally identifiable information, such as your name, telephone number, credit or debit card number, mailing address, email address or any other information identifying you, unless you voluntarily provide it in connection with your purchase or use of any products or services, or your participation in any promotions or other activities, offered through this website. For example, personally identifiable information may be collected when you (a) purchase a TicTalk phone and create a new customer account, (b) activate your TicTalk phone through this website, or (c) access your user account to configure the settings on your TicTalk phone and/or enter information for the purpose of using various functions or features of the TicTalk phone. The type of information that can be entered for the TicTalk through the user account on this website includes phone numbers, calendar events, tasks and text messages, as more fully described on the TicTalk packaging and/or on this website.

From time to time, you may have the opportunity to participate in surveys, contests, events or other promotions offered via this website, and we will collect whatever information you may provide on a voluntary basis at those times. Furthermore, to the extent that you choose to send us questions, comments or other feedback via this website, we will collect the information that you provide in those instances.

Use and Sharing of Information

We may use any aggregate data (which does not identify you) and share it with third parties for legitimate business purposes in the normal course of our business. However, we will only use personally identifiable information to provide any products or services that you have purchased, any TicTalk functions or features that you have requested, or any promotions or activities that you have selected, and to contact you, as necessary, in connection with those products, services, functions, features, promotions or activities. For example, if you register for a contest, we will use the registration information to notify contest winners.

We will not share personally identifiable information with third parties except in special circumstances where access to such information is necessary for such third parties to assist Modeci in (i) processing or fulfilling a purchase order or other request from you, (ii) enabling use of the TicTalk phone for its intended purposes, (iii) providing wireless service, customer service (including customer support and technical support) or other service for your TicTalk phone, (iv) administering this website, or (v) sponsoring a promotion or other activity offered on this website. Modeci will ensure that such third parties are under a confidentiality or secrecy obligation with respect to such information.

Please note that we may be required to disclose personally identifiable information collected via this website in response to a legal request, subpoena, court order or similar law enforcement or judicial process. In that event, we will use reasonable efforts to secure confidential treatment of any personally identifiable information so disclosed. Also, in the event that our assets or intellectual property rights relating to the TicTalk phone are sold, transferred or licensed to a third party, personally identifiable information may be transferred to such third party subject to its express agreement to comply with this privacy policy.

Safeguarding of Information

Modeci takes reasonable precautions to preserve the confidentiality, security and integrity of personally identifiable information collected through this website, including using secure databases, Internet firewalls and data encryption. We also require a username and password to permit access to the user account for configuring the TicTalk phone.

Children's Privacy Policy

Although children may browse any non-secure (public) pages of this website, Modeci requires that only adults (18 or older) purchase products or services through the secure pages of this website. Furthermore, Modeci requires that adults activate the TicTalk phone and obtain the username and password for the user account that is accessible at the home page of this website. The username and password for the user account should not be provided to any children that will be using the TicTalk phone.

Please note that, by logging into his or her user account on this website, the account holder (e.g., parent or legal guardian) can enter certain information about the child that will be using the TicTalk phone, such as the lists of "Anytime" and "Reward" phone numbers that the child can call or be called from, the child's calendar events and "To-Do" list, and text messages to be sent from this website to the child. By entering such information, the account holder is considered to have consented to our use of such information for the purpose of enabling the use of the TicTalk by the child. Modeci will treat such information as personally identifiable information, and will protect such information in accordance with our privacy policy as described above. Modeci will not attempt to contact any children without prior parental (or legally equivalent) consent or notification.

While the TicTalk phone may be enabled to send messages, or responses to messages, to a select group of contacts entered through the password-protected user account, this website does not offer children the ability to publicly post (e.g., through a chat room or message board) or otherwise publicly distribute personally identifiable information. Any messages, or responses to messages, sent by the TicTalk will be posted to, and can be viewed from within, the user account. As with information entered through the user account, Modeci will treat messages and responses received from the TicTalk and posted to the user account as personally identifiable information, and will protect such information in accordance with our privacy policy as described above.

Except for information entered and messages or responses received through the password-protected user account as described above, Modeci does not solicit or collect children’s personal information. The account holder, at anytime, may review, change or delete any (currently active) information entered or received through the user account.

Email Lists

We may establish one or more email lists to disseminate information regarding the TicTalk phone and related products, services, promotions or other activities. At your request, or with your consent, we will add your email address to a particular list, and occasionally contact you by email with TicTalk related information that may be of interest to you. You can opt out of receiving such emails at anytime, and we will then remove your email address from the corresponding list.

Changes to Policy

From time to time, Modeci may change its privacy policy in response to its business needs, or as required by law. However, Enfora will not make any material changes to our privacy policy that render it less protective of information previously collected without providing notice to, and obtaining the consent of, affected persons.
